Battery, Power Storage & Electrical Product Safety Disclaimer
Adwin manufactures and deals in lead-acid batteries, lithium-ion batteries, inverters, solar power systems, LED lighting, and related electrical products. Such products, by their inherent nature, involve stored electrical and chemical energy and carry risks if manufactured, handled, installed, charged, stored, transported, or disposed of incorrectly, including but not limited to risk of fire, explosion, short-circuit, electric shock, chemical leakage, corrosion, burns, or property damage.
Strict Instruction Compliance: All products must be installed, charged, used, stored, and maintained strictly in accordance with the instructions in the product manual, warranty card, and safety labelling accompanying the product, and applicable Bureau of Indian Standards (BIS) and manufacturer specifications.
- Use of a product for any purpose other than its intended use;
- Installation, repair, or modification by unauthorised or unqualified persons;
- Use of non-genuine chargers, connectors, or spare parts;
- Tampering with battery management systems, casings, or safety mechanisms;
- Exposure to conditions outside specified operating parameters (including extreme heat, moisture, physical damage, or short-circuiting); or
- Failure to follow charging, ventilation, or storage instructions.
Safe Disposal & Environmental Compliance: Lithium-ion and lead-acid batteries must never be punctured, crushed, incinerated, immersed in water, short-circuited, or disposed of in domestic or municipal solid waste. Users and dealers must dispose of used/end-of-life batteries only through authorised collection or take-back mechanisms in compliance with the Battery Waste Management Rules, 2022 and the E-Waste (Management) Rules, 2022, as amended, and are solely responsible for compliance with such disposal obligations where the product has left Adwin’s custody.
E-Mobility, E-Rickshaw and Automotive Product Disclaimer
Adwin's ARAI approval, where held, relates to compliance of specified batteries with applicable e-rickshaw battery standards and does not constitute, and must not be construed as, homologation, certification, or approval of any complete vehicle, its roadworthiness, or its fitness for registration.
Purchasers, assemblers, dealers, and operators of e-rickshaws, e-bikes, or other electric vehicles into which Adwin batteries are fitted are solely responsible for ensuring that the complete vehicle complies with the Motor Vehicles Act, 1988, the Central Motor Vehicle Rules, 1989, and applicable state transport and registration requirements before such vehicle is registered, operated, or plied on public roads.
Adwin is not responsible for the compliance, safety, or performance of any third-party vehicle chassis, motor, controller, or component with which its batteries are used.
Certifications, Standards and Awards
References on the Website to ISO 9001:2015, ISO 14001:2015, ARAI approval, CE certification, or any other certification, standard, licence, or award reflect the status believed by Adwin to be current as of the date of publication.
Certifications are subject to periodic audit, renewal, suspension, withdrawal, or scope variation by the relevant certifying or regulatory body, and Adwin does not guarantee that any certification referenced remains valid, unmodified, or in force at the time a User views the Website. Partnership Content & Projections: Content on the Website relating to becoming a dealer, distributor, or business partner (including any reference to benefits, support, or business advantages of partnership) is general and promotional in nature. Liability Cap: Without prejudice to the generality of the foregoing, and to the fullest extent permitted by law, Adwin's aggregate liability under this Disclaimer, however arising, shall in no event exceed INR 1,000 (Rupees One Thousand only).
This limitation is without prejudice to any separate, specific written product warranty issued by Adwin at the point of sale, which shall be governed exclusively by its own terms, and does not exclude or restrict liability that cannot lawfully be excluded under the Consumer Protection Act, 2019 or other mandatory applicable law, or liability for death or personal injury caused by Adwin's proven gross negligence, fraud, or wilful misconduct.
Indemnity
The User agrees to indemnify, defend, and hold harmless Adwin and its directors, officers, employees, and group companies from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or connected with the User’s misuse of the Website, breach of this Disclaimer, misuse or unauthorised modification of any Adwin product, or violation of applicable law.
Force Majeure
Adwin shall not be liable for any failure or delay in the availability of the Website, its content, or in the supply, delivery, or servicing of products caused directly or indirectly by circumstances beyond its reasonable control, including but not limited to acts of God, natural disaster, fire, flood, pandemic, war, riot, strike, labour dispute, governmental action or regulatory change, power failure, telecommunications or internet failure, or failure of third-party suppliers or logistics providers.
Severability
If any provision of this Disclaimer is held by a court or authority of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be so modified, and the remaining provisions of this Disclaimer shall continue in full force and effect.
